      PROJECT: CONSTRUCTION OF MOTORWAY ON CORRIDOR Vc, SECTION POPRIKUŠE-ZENICA NORTH (DONJA GRAČANICA), SUBSECTION PONIRAK - VRACA

      CONSULTANCY SERVICES FOR SUPERVISION OF WORKS

      INVITATION FOR EXPRESSION OF INTEREST

      Bosnia and Herzegovina (the Borrower) has signed loan agreement with European Investment Bank (hereinafter “EIB” or “The Bank”) to finance priority sections of the motorway on the route of Pan European Corridor Vc through Bosnia and Herzegovina. The Federation of Bosnia and Herzegovina (the Beneficiary) intends to apply part of the proceeds of this loan toward the cost of civil works and consulting services, to be procured for the subsection of motorway from Ponirak to Vraca.

      The motorway subsection from Ponirak to Vraca will be constructed within the following civil works contract:

      • Contract No. JPAC 851-B83-17: Construction of motorway on Corridor Vc, section Poprikuše-Zenica north (Donja Gračanica), subsection Ponirak – Vraca, total length of 2,65 km. Works will be financed through the loan agreement signed with the EIB.

      Assignment Description:

      The Consultant shall act in the role of Engineer and its outputs will have to comply with current local laws and regulation concerning construction, supervision, civil works quality control, environmental protection and other related areas (Law on Physical Planning and Utilization of Land at the Level of the Federation of Bosnia and Herzegovina, Guidelines for Road Designing, Construction, Maintenance and Supervision, Law on Environmental Protection, etc.).

      The construction supervision services shall include the following:

      • Supervision of the construction works in a role of the Engineer by FIDIC conditions and in accordance with local laws;

      • Pre-construction activities, such as verification of site demarcation and compliance with required permits issued by competent local authorities for asphalt plants and quarries prior to the issue of the commencement order;

      • Technical assistance during works execution;

      • Control of contractor’s preliminary test and production specification of materials;

      • Supervision of laboratory measurements and verification of compliance with contractual obligations;

      • Supervision of the environmental management plan and implementation of mitigation measures;

      • Proper programming, recording, measurement and accounting of the works by means of appropriate management and measurement techniques;

      • Preparation and delivery of progress reports and other reports.


      Status of Selection Process:

      Interested firms are hereby invited to submit their expressions of interest. This Invitation shall be followed by a short listing of consulting firms and the short listed firms will be formally invited to submit proposals.


      Assignment Start Date and Duration:

      The assignment is expected to start in Q2 of 2018 with an estimated duration of 30 months and Defects Notification Period of 24 months.


      Maximum Budget available for the Assignment:

      387 man/months for expert staff.

      The Consultant must determine whether any indirect taxes/VAT are chargeable on the proposed services and state the basis for such. If any indirect taxes/VAT are payable, the Client will have to pay indirect taxes/VAT element to the services directly to the Consultant unless otherwise agreed.

      European Investment Bank - EIB.


      Eligibility Restrictions:

      The invitation for Expressions of Interest is open to firms and joint ventures from all countries. Firms and joint ventures may not be eligible to tender in application of EIB Guide to Procurement, and within the framework of exclusion procedures published on the EU Sanction lists.


      Consultant profile:

      The Employer is seeking for a Consultancy firm able to propose a skilful and experienced individual Consultant who will be able to exercise the role of the Engineer and capable of ensuring successful project implementation and completion. A consulting firm shall be engaged for this assignment and is expected to procure the services of a multidisciplinary team of both international and local experts as appropriate

      The Consultant is expected to have relevant expertise and experience from similar assignments involving FIDIC Engineer services in the transport sector (motorway construction). Relevant experience from EBRD’s countries of operation, in particular, previous experience in working on similar assignments in Bosnia and Herzegovina would be seen as an advantage.

      The following selection criteria will be applied to candidates. In case of applications submitted by a JV or Consortium, these selection criteria will be applied to the JV/Consortium as a whole:

      (a) the average annual turnover of the applicant for the past five years (2012-2016) must exceed 3.000.000 EURO;

      (b) the audited financial statement and balance sheets for the past five years (2012-2016) must demonstrate the soundness of the applicant’s financial position, showing long-term profitability. Consistent losses or a risk of insolvency shown in the accounts may be cause for the disqualification of the applicant;

      (c) the applicant has completed (i.e. provisional acceptance or defects liability certificate issued) in the past five years (2012-2016), at least 2 (two) major similar projects in motorway works as FIDIC Engineer with consultancy services value of 1.800.000 EURO or more per project;

      (d) in case of JV or Consortium, the Leading Company shall meet not less than 60% and other partners shall meet not less than 30% of the qualifying financial criteria (a) given above

      Interested consulting firms must provide information indicating that they are qualified to perform the services as follows:

      (a) Applicant’s average annual turnover for the previous 5 (five) years (2012-2016) in accordance with Form FIN-2: Average Annual Turnover;

      (b) Audited financial statement and balance sheets for the past five years (2012-2016);

      (c) Applicant’s general experience (details of experience and description of assignments undertaken in the previous 5 (five) years) in accordance with Form EXP-1: General Experience and Form EXP-2: Specific Experience. Any available reference letters from Employers of completed contracts should also be submitted;

      (d) In case of JV or Consortium, form of association (sub-contractor/joint venture) for the execution of the contract, if the case may be, and the lead company in accordance with the Form ELI-2: JVCA structure and Form ELI-3: JVCA Information Sheet. The same information and documentation as for the lead company shall be requested for the associated company/companies;

      (e) Letter of Application;

      (f) Company profile in accordance with Form ELI-1: Applicant’s Information Sheet;

      (g) Company background and history overview (attached to the Form ELI-1);

      (h) CV’s (max. three pages) of staff who could be available to work on the assignment, clearly showing that their experience covers the main works activities above, in accordance with Form PER-1: Personnel Capabilities Form and Form PER-2: Resume of Proposed Personnel;

      (i) A list of ongoing contracts in accordance with Form FIN-4: Current Contract Commitments/Services in Progress

      The applicant is expected to examine all instructions, forms, terms and information in the Invitation for Expression of Interest. Failure to supply all information or documentation required by the Invitation for Expression of Interest may result in the rejection of the application.

      In context of the staff positions required under item h), the following key experts should be included in applicant’s EoI at minimum:

      - Engineer – Supervision Coordinator;

      Qualifications and skills

      A graduate engineer (civil engineer, where university degree has been awarded on completion of three or more years study in a university or equivalent institution) with twenty (20) or more years of professional experience in the field of Civil Engineering. He/she shall have good working knowledge of FIDIC type contracts (International Federation of Construction Engineer).

      He/She will be chartered engineer under the BH law (“položen stručni ispit“ or holding an equivalent professional engineering qualification from another country)

      General professional experience

      At least fifteen (15) years of experience in design, construction, construction supervision and contract management of road projects.

      Specific professional experience

      He/she will have fifteen (15) or more years of international experience.

      He/she shall demonstrate that he/she has experience in similar positions in construction supervision and contract management in at least two projects under conditions similar to those prevailing in Bosnia and Herzegovina.

      He/she shall demonstrate that he/she has occupied similar posts as FIDIC engineer on three or more similar road projects with a cumulated value of the works of 210 million Euro.

      Language skills

      • Fluency in both written and spoken English.

      • Working knowledge of local language will be considered an asset.

      - Main Supervision Tunnel Engineer (Civil Engineer);

      - Main Supervision Geological Engineer;

      - Main Supervision Road Engineer;

      - Main Quantity Engineer and Claim Expert

      Qualifications and skills

      For Main Tunnel, Main Road and Main Quantity and Claim expert.

      A graduate engineer (civil engineer, where university degree has been awarded on completion of three or more years of study in university or equivalent institution) having at least fifteen (15) years of professional experience in the field of Civil Engineering.

      He/She will be chartered engineer under the BH law (“položen stručni ispit“ or holding an equivalent professional engineering qualification from another country)

      For Main Tunnel Engineer:

      A graduate engineer (Civil Engineer, where university degree has been awarded on completion of three or more years of study in university or equivalent institution) having at least fifteen (15) years of professional experience in the field of Civil Engineering.

      For Main Geological Engineer:

      A graduate engineer of Geology (where university degree has been awarded on completion of three or more years of study in university or equivalent institution) having at least fifteen (15) years of professional experience in the field of Geology.

      He/She will be chartered engineer under the BH law (“položen stručni ispit“ or holding an equivalent professional engineering qualification from another country)

      General professional experience

      For Main Tunnel, Main Geologist, Main Road and Main Quantity and Claim expert:

      At least ten (10) years of experience in similar functions in motorway works supervision and contract management, for each Engineer in his/her particular field of expertise.

      Specific professional experience

      For Main Road, Main Tunnel, Main Bridge, Main Geological Engineer,

      He/She shall demonstrate that he/she has occupied similar posts in their field of expertise on at least two projects of similar nature and characteristics to the one object of this Terms of Reference.

      He/she shall have five (5) or more years of international experience, as well as at least two projects under conditions similar to those prevailing in Bosnia and Herzegovina.

      The Main Supervision Tunnel Engineer shall demonstrate that he/she has occupied similar position in their field of expertise on at least two similar projects which included construction of twin tube tunnel more than 1500 m long.

      The Main Supervision Road Engineer shall demonstrate that he/she has occupied similar positions in their field of expertise on at least two projects of similar nature relevant to the proposed position.

      The Main Supervision Geological Engineer, shall demonstrate that he/she has occupied similar position in their field of expertise on at least two projects of similar nature relevant to the proposed position.

      The Main Quantity Engineer and Claim Expert, shall demonstrate that he/she has occupied similar position in their field of expertise on at least two projects of similar nature relevant to the proposed position. The Main Quantity Engineer and Claim Expert shall demonstrate that he/she has extensive experience in claims, evaluation of variation orders, evaluation of extension of time claims and payment issues.

      Language skills

      • Good working knowledge of both written and spoken English.

      • Working knowledge of local language will be considered an asset.

      (Site Diary is kept both in local and English language)

      Pursuant to “Decree on construction site management, compulsory site documentation and participants in the construction activities“ a supervision of works can only be performed by the legal entity being registered for performing of the respective activity and possessing a license of the Federal Ministry of Physical Planning. Therefore, applicants are required, to provide the statement that they:

      a) are already registered for performing the construction supervision activities and that they possess the license of Federal Ministry of Physical planning, or

      b) will register themselves for provision of construction supevision services under the laws of Federation of Bosnia and Herzegovina and obtain the required licence prior to contract award.
