The role of the theatre consultant will include advising the authority in relation to the international design competition, assisting in the preparation of a comprehensive output specification for the detailed design, construction and maintenance requirements of the Abbey Theatre, to assist the authority in evaluating and selecting the successful tendering developer and to provide a monitoring role throughout the construction phase of the project. ADDITIONAL INFORMATION: (a) The successful tenderer shall act under the direction and management of the technical adviser procured by the authority and/or the National Development Finance Agency under a separate competition. (b) Tenderers shall state if any of (and the reasons why) information supplied by them in response to this notice is confidential or commercially sensitive or should not be disclosed in respect of a request for information under the Freedom of Information Acts 1997-2003. (c) Any contract award is subject to production of a current tax clearance certificate from the Revenue Commissioners in Ireland, or for a non-resident, a statement from the Revenue Commissioners in Ireland confirming suitability on tax grounds. (d) All costs incurred by tenderers in preparing tenders must be borne by them. The Authority accepts no liability for these costs, irrespective of the outcome of the competition, or if the competition is postponed or cancelled. (e) The authority may terminate this competition (or any part thereof), change the basis of and the procedures for the bidding process, at any time, or procure the project by alternative means if it appears that the project can thereby be more advantageously procured. The most economically advantageous or any tender will not necessarily be accepted. (f) For further information on the procedure and conditions for opening tenders, tenderers′ attention is drawn to the Instructions to tenderers. (g) Chapter 1, Part 18, Taxes Consolidation Act, 1997 provides for a professional services withholding tax to be deducted at source from payments due to the successful tenderer. This tax (currently at a rate of 20%) will be deducted from payments made in respect of work carried out and will be remitted to the Irish tax authorities. This tax is refundable on application to the Irish Revenue Commissioners. (h) All times set out in this contract notice are in local Irish time. (i) All monetary amounts should be quoted in EUR.
