      are met: In order for the ability for conducting professional activities
      to be proved, the economic operator shall submit a document for registered
      proffesion as a proof that he is registered as a physical or legal person
      for pursuing acitvity connected with the subject of the contract for
      public procurement or a proof that he belongs to an appropriate
      professional association in accordance with the regulations from the
      country where he is registeredin.

      Information and formalities necessary for evaluating if the requirements
      are met: Biography of the person who will be hired for managing the
      project with listed projects which that person has directed, a statement
      that the person who will manage the project will be available for
      communication with authorities and experts of the contracting authority at

      be undersigned by the engagement party, as well as the economic operator.

      rendered design. Confirmation by the user of the facility for which it was

      the project was intended that facilities are in operation and that they

      for the design or equivalent document for foreign person under the Law on

      for hydrotechnical constructions and installations of the project, signed
      by both parties. If the person is directly employed by the economic
      operator, he is then required to submit a document to prove employment
      (document issued by competent authority). A tatement of the contracted
      civil engineer that he would personally prepare, sign and certify parts of
      the project concerning the construction and hydro-technical installations.
      Notice:
      — The certificates listed in this section that will serve to prove the
      required capability must contain an area of the projected facility,
      — The economic operator shall submit a statement that if his bid is the
      winning, after the second stage of the tender he will keep the same
      persons whose qualifications apply in the first stage and which are
      included in the engagement and submitted in addition to the application
      for participation,
      — In case of change of employed persons whose qualifications the economic
      operator applied with in the first stage, the economic operator is obliged
      to timely inform the contracting authority for customizing the engagement
      party and submit resume to confirm the ability of the person who will
      replace him. New applicants must fully meet the same criteria listed in
      paragraph 2.4.1 and to prove the documents listed in point 2.4.2, as
      appropriate for each candidate. The contracting authority shall reject any
      proposed candidates who do not meet the required criteria.

      III.2.3) Technical capacity
      Information and formalities necessary for evaluating if the requirements
      are met:
      2.4.4 The technical and professional ability of the economic operators may
      be supported by another entity, regardless of the legal relations between
      the economic operator and the entity. If the economic operator proves its
      technical and professional ability referring to the support of another
      entity, he shall demonstrate that support with valid evidence that the
      entity will make available adequate technical and professional resources.
      Against the entity that provides technical and professional support a
      final judgment may not be rendered for participation in a criminal
      organization, corruption, fraud or money laundering.
      To be qualified as capable for perfoming the subject contract for public
      procurement in terms of his technical and professional abitlity, the
      economic operator shall fulfill the next minimal conditions:
      Minimum level(s) of standards possibly required:
      — to own an A liscence for design,
      — to own a liscence for preparation of urban plans,
      — To hire a person who will manage the process of designing by having 5
      year experience in managing of projects from the field of design or
      construcition,
      — To hire an architect who has designed at least 3 facilities from the
      field of health care (large hospital facilities) with over 30. 000 m2
      area, built in the countries members of OECD and the same to be in
      function, as a chief architecture designer who will design it, sign it and
      certify the part of the project in terms of architecture and urbanisation,
      — to hire a mechanical engineer with exeprience in designing mechanical
      and thermotechnical instalations of at least 2 big hospital facilities
      with over 30.000 m2 area built in the countries members of OECD, and the
      same to be in function, as a chief designer of mechanical and
      termotechnical instalations who will design it, sign and certify the part
      of the project in terms of the respecitive part of the project,
      — to hire an electrical engineer with experience in designing of
      instalations of low and high current and telecommunications of facilities
      with over 30.000 m2 built in the countries members of OECD and the same
      are in function, as a chief designer of low, high current and
      telecommunication instalations who will design, sign and certify the part
      of the project in terms of the respecitive part of the project,
      — to hire civil engineer with experience in design and construction of
      hydro-technical installations in buildings with area over 30,000 m2 built
      in the countries members of OECD and the same are in function as the chief
      designer for construction and hydro-technical installations, which he will
      prepare, sign and certify part of the project that concerns the subject of
      the project.

      For that purpose, the contracting authority is executing a procedure for
      grantig the contract for public procurement of works using restricted

      I. Instructions for the economic operators
      1. General information
      1.1 Definitons
      1.1.1 Certain terms used in this tender documentation have the following
      meaning:
      — „Contract for public porcurement“ is a contract of financial interest
      concluded in writing between the contracting autrhority on one side and
      the contractor on the other, whose case is executing works which are a
      subject of the contract,
      — „Procedure for awarding the public procurement“ is a procedure executed
      by the contracting autrhority, whose aim or action is execution of works:
      — .has the right to submit an application for participation, and only the
      chosen candidates from the contracting authority are invited to submit a
      bid:
      — „Tender documentation“ is a set of documents, information and conditions
      which are basis for preparation, submission and evaluation of the

      efficiency and economy in the area of public procurement,

      signature can be identified.

      1.3 Subject of the public procurement contract
      1.3.1 The subject for the contract for procurement of services is:
      — The architectural- urban design for the whole complex of the University
      Clinics in accordance with the Construcition Law (Official Gazzete no.
      59/2011 and Official Gazzete of Republic of Macedonia no. 13/2012) and the
      Law for spacious and urban planning,
      — three conceptual solutions for the new clinical block,
      — preliminary design for construction of new clinical block within the
      University Clinics complex,
      — Final project design for construction of a new clininical complex at the
      University clinics Skopje in accordance with the Law of construction
      (Official Gazzete no. 59/2011 and Official Gazzete of Republic of
      Macedonia no. 13/2012) with functional connection between the facilities
      at the Gynecology Clinic, Clinic of Oncology and Radiotherapy and the
      Surgical Clinics in accordance with the admitted preliminary design,
      — Final project design for reconstruction and adaptation of the Surgical
      Clinics facility in accordance with the Construction Law (Official Gazzete
      no. 59/2011 and Official Gazzete of Republic of Macedonia no. 13/2012),
      — Final project design for reconstruction and adaptation of the Pediatrics
      Clinic facility and reconstruction and adaptation of the Transfusion and
      Hematology Clinic facilities, that will be transferred at the new clinical
      complex for the need of the Pediatric Surgery.
      1.3.2 Detailed description of the public procurement contract subject will
      be given in the technical specifications, i.e. detailed project programmes
      for all stages of the construction will be an integral part of the tender
      documentation for the second stage of the restricted procedure.
      1.4 Type of procedure for awarding a public procurement contract
      1.4.1 The contract for public procurement will be awarded by applying the
      restricted procedure
      1.4.2 This procedure will not be implemented by applying electronical
      means but through the Electronic system of public procurement.
      1.4.3 The minimum number of candidates to whom the contracting authority
      after the conveyed evaluation of the admitted applications for
      participation will give written invitation to for submission of bids in
      the second stage from the restricted procedure, is 5 candidates, whereas
      the maximum number of candidates is not limited. If the number of the
      candidates meeting the criteria for the establishment of ability is less
      than the minimum number predicted in this subsidiary point, the
      contracting authority keeps the right to cancel the procedure or to start
      a procedure only with those candidates who meet the criteria for
      establishment of ability, if their number is enough to provide a real
      competiton.
      1.5 Applicable regulations
      1.5.1 This procedure is implemented in accordance with the Law on Public
      procurement, announced in the Official Gazzete of Republic of Macedonia
      no. 136/07, 130/08, 97/10, 53/11 and 185/11 and the adopted bylaws.
      1.5.2 During the preparation of his application for participation, the
      economic operator should bare in mind the applicable regulations from the
      areas of tax and other taxes, employment relations, working conditions and
      protecton at work, applicable regulations in the area of construction and
      design. All regulations may be find in the appropriate editions in the
      Official Gazzete of the Republic of Macedonia. Additional information in
      terms of the applicable regulations from the areas mentioned above, the
      bidder can get from the Public Revenue office, Customs administration and
      the Ministry of Finance (for the tax and other taxes), the Ministry of
      Labour and Social policy (for employment relations, working conditions and
      protection at work), Ministry of Transport and communications (regulations
      in the part of construction and design).
      1.6 Source of funds
      1.6.1 The funds for realization of the contract for public procurement
      which is the subject of this procedure are provided by the income account
      of the Ministry of Health.
      1.7 Right of participation
      1.7.1 The right for submission of application for participation has every
      interested domestic and foreign legal and physical person – economic
      operator, registrated for performing the activity connected with the
      subject of the contract for public procurement, who owns A liscence for
      design in accordance with the category of the facility that needs to be
      designed and the Construction Law, and who raised the tender documentation
      for the first stage from the restricted procedure from the contracting
      authority. Foreign Economic operators shall own appropriate document valid
      for the country where they come from by which they prove the ability for
      design of that kind of facilities and which corresponds to the A liscence
      in accordance with the Construcition Law (Official Gazzete no. 59/2011,
      and Official Gazzete of Republic of Macedonia no. 13/2012)
      1.7.2 A right to submit an application also has a group of economic
      operators without obligation of association in a particular legal form.
      1.7.3 The group of economic operators has to appoint their representative
      who will have an athorization to perform all the business activities for
      and in the name of any party and in any parties from the group of economic
      operators at the first stage in the restricted procedure.
      1.7.4 In the case of application for participation from a group of
      economic operators, the representative of the group in his application for
      participation shall submit a written authorization signed by all the
      members of the group of economic operators who authorize the
      representative to submit an application for participation and to assume
      all rights and obligations on their behalf and for their account. All the
      members of the group of economic operators are individualy and jointly
      responsible before the contracting authority for performing their
      obligations. The contracting autrhority will communicate with the
      representative of the group of economic operators.
      1.7.5 The economic operator within the same procedure for appointment of
      the contract for public procurement may participate only in one
      application for partcipation. All applications for participation will be
      cancelled if the economic operator:
      — participates in more than one individual and/or as a member of joint
      application for participation or,
      — participates as subcontractor in other individual and/or as a member of
      joint application for participation.
      1.7. The economic operator may engage external designers – physical and
      legal person which in such a case keep the moral rights, but every
      material rights of their copyright work created for excution of the
      subject matter of the procurement, has to be fully and unlimited in time
      conveyed to the contracting authority, and as full compensation for
      material rights to consider the compensation received in accordance with
      the contract regulating the performance of the subject of procurement. The
      economic operator has an obligation even if the economic and financial
      situation, as well as the technical and proffesional ability of the
      economic operator is not supported by other subjects, to submit
      documentation for determining of the ability of the engaged outside
      cooperators who will be included in the subject procurement.
      1.7.7 Those who participated in the preparation for the tender
      documentation, as well as those who participate and help in evaluation of
      the applications for participation must not be candidates, subcontractors
      or members in a group of candidates in the procedure for awarding the
      contract.
      1.8 Costs for submission of partcipation application
      1.8.1 The economic operator bears all costs connected with the preparation
      and the submission of the application for partcipation, and the
      contracting authority is not responsible for those costs, no matter the
      conduct and outcome of the proceedings for awarding the contract for
      public procurement.
      1.9 Preventing conflict of interests
      1.9.1 For preventing conflict of interests in the proceedings for awarding
      the contract for public procurement, regulations of the Law for preventing
      conflict of interests are applied.
      1.9.2 In the procedure of awarding the contract for public procurement,
      the president, vice president, members and the deputies of the members of
      commision for public procurement, as well as the authorized person sign a
      statement for non existent conflict of interests which is a part of the
      file of the conducted procedure.
      1.9.3 In case of conflict of interests with the president, his deputy, the
      members and their deputies in the commision for public procurement, the
      same are withdrawn from work of commision and are replaced with other
      persons.
      1.9.4 In case of conflict of interests with the authorized person, the
      same person with a particular solution authorizes another person among the
      officials or employed with the contracting authority to bring the proper
      decisions and to sign the contract.
      1.10 Way of communication
      1.10.1 Every requirement, report or other documents in the procedure are
      sent in written form. Each document is recorded at the moment of sending,
      i.e. At the moment of receiving.
      1.10.2 Documents, apart from the application for participation, are sent:
      — by mail,
      — by fax or,
      — by elecronic means.
      1.10.3 The document which was sent by fax, the deliverer is obliged to
      deliver it by mail or by applying elecronic means within two days from the
      day of the sent document by fax.
      1.10.4 The way of submission of the application for participation is
      confirmed in item 4 of the Instructions for economic operators.
      1.11 Confidential information
      1.11.1 The contracting authority will protect the information which the
      economic operator assigned them as confidential, especially when it is
      about a business secret or rights of intellectual property, except in the
      case by law, the contracting authority is obliged to submit these
      information to the authorities (in case of appeal, initiating an
      administrative dispute etc.) For that purpose, the economic operator shall
      make a list of confidential information by using the Form of a list of
      confidential information given in addition to this tender documentation,
      and the same should be submitted together with his bid.
      1.11.2 If the economic operator does not submit the list of confidential
      information together with his bid, the contracting authority will think
      that the subject bid does not contain any confidential information.
      1.11.3 The price of the offer is not considered as confidential
      information in any case.
      2. Ability of the economic operators
      2.1 Way of proving the ability
      2.1.1 By the application for partcipation, the economic operator is
      required to submit supporting documentation by which he will prove:
      — the personal state,
      — the ability to perform professional activity,
      — technical and professional ability,
      — standards for the systems of quality.
      2.1.2 The aquired documentation is submitted in original form or in a copy
      verified by the economic operator with a stamp or with signature of the
      authorised person, labelled „true to the original“
      2.1.3 During the check of the completeness and validity of the
      documentation for confirmation of the ability of the economic operator and
      during evaluation of the application for participation, the commision may
      require the economic operators to explain and amend document, provided it
      is not a case of considerable deviations of the required documentation.
      2.1.4 The economic operator submits the required explanation in a written
      form within the period determined by the contracting authority.
      2.2 Personal state
      2.2.1 The contracting authority will dismiss the economic operator from
      the procedure for awarding a contract for public procurement if:
      — a final judgement was rendered for partcipation in a criminal
      organization, corruption, fraud or money laundering in the last 5 years,
      — a minor penalty was imposed for a ban for partcipation in proceedings
      for public call, awarding the contracts for public procurement and
      contracts for public private partnership,
      — a minor penalty is imposed for temporary or permanent ban for performing
      certain activities,
      — he is in bankruptcy or liquidation procedure,
      — he has unpaid taxes, contributions and other taxes, unless the economic
      operator is aproved with deffered payment of taxes, contributions and
      other taxes in accordance with the proper regulations and the same to be
      regularly paid,
      — he is sentenced with sanction – prohibition for pursuing professional
      activity or duty, which is a temporary prohibition for pursuing a certain
      activity and,
      — he gives false information or does not submit the information required
      from the contracting authority.
      2.2.2 As proof for his personal state, the economic operator submits the
      following documents:
      — A statement that the economic operator has not been rendered a final
      judgement for participation in a criminal organization, corruption, fraud
      or money laundering in the last five years,
      — A certificate that there isn't a bankruptcy procedure from authorities,
      — A certificate that there isn't a liquidation procedure from authorities,
      — A certificate for paid taxes, contributions and other taxes from the
      autorities of the country where the economic operator is registered in,
      — A certificate from the Registry of penalties for criminal offences of
      the legal persons that a minor penalty ban for partcipation in a procedure
      for public procurement is not rendered, awarding contracts for public
      procurement and contracts for public-private partnership,
      — A certificate that The Registry of penalties for criminal acts of the
      legal persons that a minor penalty ban is not rendered temporary or
      permanent,
      — A certificate that by final judgement a criminal sanction is nor
      rendered – ban for pursuing prfessional activities or duties, i.e. A
      temporary ban for pursuing certain activity.
      2.2.3 The statement from line 1 in the subpoint 2.2.2. si issued and
      signed by the economic operator himself and the same does not need to be
      certified by authorites.
      2.2.4 A Certificate that there is no bankruptcy and liquidation procedure
      and a certificate of the register of fines for criminal offenses from line
      5 and 6 of subpoint 2.2.2, issued by competent authorities in the country
      where the economic operator is registered. Macedonian authority to issue
      these certificates is the Central Register of the Republic of Macedonia.
      2.2.5 The certificate for paid taxes and other charges issued by the
      competent authority of the country where the economic operator is
      registered. Macedonian authority to issue such certificates is the Public
      Revenue office.
      2.2.6 The certificate from line 7 from subpoint 2.2.2 is issued by
      authorities in the country where the economic operator is registered. In
      Republic of Macedonia authorized officials for issuing of this certificate
      is the Central Registry of the Republic of Macedonia.
      2.2.7 Documents from subpont 2.2.2 must not be more than 6 months old
      counted from the final deadline for submission of applications for
      partcipation backwards.
      2.2.8 If the country where the economic operator is registered does not
      issue the documets stated in subpont 2.2.2 or if they do not contain all
      the cases mentioned before, the economic operator may submit a statement
      certified by authorities.
      2.3 Ability for conducting proffesional activities
      2.3.1 In order for the ability for conducting professional activities to
      be proved, the economic operator shall submit a document for registered
      proffesion as a proof that he is registered as a physical or legal person
      for pursuing acitvity connected with the subject of the contract for
      public procurement or a proof that he belongs to an appropriate
      professional association in accordance with the regulations from the
      country where he is registeredin.
      2.4 Technical or proffesional ability
      2.4.1 To be qualified as capable for perfoming the subject contract for
      public procurement in terms of his technical and professional abitlity,
      the economic operator shall fulfill the next minimal conditions:
      — to own an A liscence for design,
      — to own a liscence for preparation of urban plans,
      — To hire a person who will manage the process of designing by having 5
      year experience in managing of projects from the field of design or
      construcition,
      — To hire an architect who has designed at least 3 facilities from the
      field of health care (large hospital facilities) with over 30. 000 m2
      area, built in the countries members of OECD and the same to be in
      function, as a chief architecture designer who will design it, sign it and
      certify the part of the project in terms of architecture and urbanisation,
      — to hire a mechanical engineer with exeprience in designing mechanical
      and thermotechnical instalations of at least 2 big hospital facilities
      with over 30.000 m2 area built in the countries members of OECD, and the
      same to be in function, as a chief designer of mechanical and
      termotechnical instalations who will design it, sign and certify the part
      of the project in terms of the respecitive part of the project,
      — to hire an electrical engineer with experience in designing of
      instalations of low and high current and telecommunications of facilities
      with over 30.000 m2 built in the countries members of OECD and the same
      are in function, as a chief designer of low, high current and
      telecommunication instalations who will design, sign and certify the part
      of the project in terms of the respecitive part of the project,
      — to hire civil engineer with experience in design and construction of
      hydro-technical installations in buildings with area over 30,000 m2 built
      in the countries members of OECD and the same are in function as the chief
      designer for construction and hydro-technical installations, which he will
      prepare, sign and certify part of the project that concerns the subject of
      the project,
      — 2.4.2 The economic operator proves the fulfillment of the minimum
      conditions stipulated in subpoint 2.4.1 by submitting:
      — Biography of the person who will be hired for managing the project with
      listed projects which that person has directed, a statement that the
      person who will manage the project will be available for communication
      with authorities and experts of the contracting authority at any time at
      all stages of design. Biography and statement are required to be
      undersigned by the engagement party, as well as the economic operator.
      Original contract (or notarized copy) for engagement of a person as
      project manager, signed by both parties. If the person is directly
      employed by the economic operator then it is required a submission of a
      document to prove employment. Minimum 2 references for successful
      management of projects of this scale of complexity,
      — The biography of the architect contracted with listed projects that
      prepared as chief designer for facilities that are already performed. The
      biography to be hand signed by the person who will be engaged and the
      responsible person of the economic operator. Minimum three confirmed
      contracting projects for healthcare facilities with an area of over 30,000
      m2 are built in member countries of OECD, quality and timely services
      rendered design. Confirmation by the user of the facility for which it was
      intended that the project facilities are in operation and that they are
      built in accordance with the respective project. A copy of the
      authorization for the design or equivalent document for foreign person
      under the Law on Construction (Official Gazette of RM no. 59/11 and no.
      13/2012). Original contract (or notarized copy) for engagement of a person
      as chief designer architect of the project, signed by both parties. If the
      person is directly employed by the economic operator, he is then required
      to submit a document to prove employment (document issued by competent
      authority). Statement of the contracted architect he would personally
      prepare, sign and certify parts of the project related to architecture and
      urbanism,
      — The biography of the contracted mechanical engineer with listed projects
      which he prepared as chief designer for thermo-technical installations for
      buildings that have been performed. Biography to be hand signed by the
      person who will be engaged and be the responsible person of the economic
      operator. Minimum of two references from contracting projects and
      thermo-technical mechanical installations or major projects include
      mechanical installations and thermo-technical health facilities with an
      area of over 30,000 m2 are built in member countries of the OECD for
      quality and timely services rendered design. Minimum of two references
      from the user facility which was intended project which confirms that
      facilities are in operation and that they are built in accordance with the
      respective project. A copy of the authorization for the design or
      equivalent document for foreign person under the Law on Construction
      (Official Gazette of RM no. 59/11 and no. 13/2012). Original contract (or
      notarized copy) for engagement of a person as chief designer for
      mechanical and thermo-technical installations, signed by both parties. If
      the person is directly employed by the economic operator, he is then
      required to submit a document to prove employment (document issued by
      competent authority). Statement of contracted mechanical engineer he would
      personally prepare, sign and certify parts of the project related to the
      mechanical and the thermo-technical installations.
      Biography of contracted electrical engineer with the listed projects which
      he prepared as a chief designer for electrical installations for buildings
      which are already in function. Biography to be handed signed by the person
      who will be engaged and responsible person of the economic operator.
      Minimum of two references from contracting projects power stations and
      telecommunications installations or major projects include power stations
      and telecommunications installations for buildings with an area of over
      30,000 m2 of high quality and timely services rendered design. Minimum of
      two references from the facility user for which the project was intended
      that facilities are in operation and that they are built according the
      respective project. A copy of the authorization for the design or
      equivalent document for foreign person under the Law on Construction
      (Official Gazette of RM no. 59/11 and no. 13/2012). Original contract (or
      notarized copy) for engagement of a person as chief designer for low and
      strong current installations and telecommunications project, signed by
      both parties. If the person is directly employed by the economic operator,
      he is then required to submit a document to prove employment (document
      issued by competent authority). A statement of the contracted electrical
      engineer that he would personally prepare, sign and certify parts of the
      project related to electrical and telecommunications installations.
      — The biography of contracted civil engineer with the listed projects are
      prepared as chief designer for hydrotechnical constructions and
      installations for buildings that have already performed the function. The
      biography to be hand signed by the person who will be engaged and
      responsible person of the economic operator. Minimum of two references
      from contracting for construction projects and hydro installations or
      major projects include construction and hydro installations for buildings
      with an area of over 30,000 m2 of high quality and timely services
      rendered design. Minimum of two references from the user object for which
      the project was intended that facilities are in operation and that they
      are built according the respective project. A copy of the authorization
      for the design or equivalent document for foreign person under the Law on
      Construction (Official Gazette of RM no. 59/11 and no. 13/2012). Original
      contract (or notarized copy) for engagement of a person as chief designer
      for hydrotechnical constructions and installations of the project, signed
      by both parties. If the person is directly employed by the economic
      operator, he is then required to submit a document to prove employment
      (document issued by competent authority). A tatement of the contracted
      civil engineer that he would personally prepare, sign and certify parts of
      the project concerning the construction and hydro-technical installations.
      Notice:
      — The certificates listed in this section that will serve to prove the
      required capability must contain an area of the projected facility,
      — The economic operator shall submit a statement that if his bid is the
      winning, after the second stage of the tender he will keep the same
      persons whose qualifications apply in the first stage and which are
      included in the engagement and submitted in addition to the application
      for participation,
      — In case of change of employed persons whose qualifications the economic
      operator applied with in the first stage, the economic operator is obliged
      to timely inform the contracting authority for customizing the engagement
      party and submit resume to confirm the ability of the person who will
      replace him. New applicants must fully meet the same criteria listed in
      paragraph 2.4.1 and to prove the documents listed in point 2.4.2, as
      appropriate for each candidate. The contracting authority shall reject any
      proposed candidates who do not meet the required criteria.
      2.4.4 The technical and professional ability of the economic operators may
      be supported by another entity, regardless of the legal relations between
      the economic operator and the entity. If the economic operator proves its
      technical and professional ability referring to the support of another
      entity, he shall demonstrate that support with valid evidence that the
      entity will make available adequate technical and professional resources.
      Against the entity that provides technical and professional support a
      final judgment may not be rendered for participation in a criminal
      organization, corruption, fraud or money laundering.
      2.5.5 If the economic operators submit a request to participate as a group
      of economic operators, the technical and professional ability is proved by
      taking into account the resources of all group members. If the group of
      economic operators performss with technical and professional support from
      a third entity or third parties, technical and professional ability shall
      be determined according to the above mentioned.
      2.5 Standards for systems of quality
      2.5.1 To qualify as capable of performing the contract for public
      procurement in terms of standards for quality systems, the economic
      operator must meet ISO 9001 standards.
      2.5.2 The economic operator proves the fulfillment of standards in
      subpoint 2.6.1 by submitting a certificate of compliance to the standard.
      3. Clarification, change and addition of the tender documentation
      3.1 Clarification of the tender documentation
      3.1.1 The economic operator may ask for clarification of the tender
      documentation in the first stage of the restricted procedure of the
      contracting authority, excusively in a written form, 6 days at the latest
      before the deadline for submission of the applications for partcipation.
      3.1.2 The contracting authority shall submit the clarification to each
      economic operator who submitted for tender documentation without
      identifying the economic operator who asked for clarification.
      3.2 Change and addition of the tender documentation
      3.2.1 The contracting authority keeps the right of 6 days before the
      deadline for submitting the applications for partcipation, of their own
      finding on the grounds of the submitted questions for clarification
      submitted by the economic operators, to change or to make an addition of
      the tender documentation, for which he shall inform the economic oprators
      who submitted the same.
      3.2.2 In case of change in the tender documentation, the contracting
      authority may continue untill deadline for submission of the applications
      for partcipation after being requested by the economic operator (if there
      are any justified reasons) and to establish at least 5 work days for
      submission of the applications for clarifications/ additions.
      3.2.3 In case of extension of the deadline, the contracting authority is
      obliged to inform each economic operator who submitted for tender
      documentation.
      4. Preparation and submission of the applications for participation
      4.1 Content of the application for participation
      4.1.1 The application for partcipation shall be prepared on the grounds of
      the original tender documentation and it is consisted of the following
      elements [to be adjusted from the contracting authority, what is not
      needed to be erased]:
      — filled in form of the application for participation,
      — filled in form of the list of confidential information (if there aren't
      any confidential information, the form does not need to be submitted),
      — filled in form for general information for the economic operator which
      is enclosed with this tender documentation,
      — filled in form for general information of the persons the Economic
      operator applies with,
      — documentation for confirmation of the personal state, specified in the
      subpoint 2.2. of the tender documentation,
      — document for confirmation of he ability for conducting the proffesional
      activity specified in item 2.3,
      — proof for confirmation of the technical or proffesional ability
      specified in item 2.4 from the tender documentation,
      — copy of the certificate for proving the system of quality specified in
      item 2.5 from the tender documentation,
      — written authorization for the representative of the group of economic
      operators (only for a group of economic operators).
      4.1.2 The economic operator shall compulsory use the forms given in this
      tender documentation and that is why they need to be filled in wihtout any
      changes in their form. Otherwise the application for participation may be
      rejected as unacceptable.[alternatively the economic operators may be
      allowed to fill in the forms in electronic form which will be provided by
      the contracting authority or will be prepared by themselves, provided they
      do not deviate from the content of the forms given with the tender
      documentation, In such case, item 4.1.2 appropriately shall be adjusted]
      4.2 Language of the application for partcipation
      4.2.1 The application for participation, as well as the whole
      correspondence and documents connected with the application for
      partcipation are submitted in Macedonian language.
      4.2.2 The printed literature may be in other language. The contracting
      authority keeps the right in the stage of evaluation of the applications
      for partcipation to ask from the candidate to translate the printed
      literature which is submitted in another language.
      4.3 Form and signing of the application for partcipation
      4.3.1 The application for partcipation is submitted in an original
      instance, written in permanent ink and signed from the authorised person
      of the economic operator or a person authorised by him. Provided the
      application for participation is signed by a person authorised from an
      authority, he shall enclose authorisation for its signing signed from the
      authorised person. All pages from the application, except for the
      unchanged printed literature, shall be initialed from the person who signs
      the same.
      4.3.2 Every writing between the lines, erasing or copying over a previous
      text is valid only if it is signed or initiated by the person who signed
      the application for participation.
      4.4 Sealing and marking the applications for partcipation
      4.4.1 Applications for participation may be submitted only by economic
      operators who have a certified copy of the tender documentation from the
      contracting autrhority.
      4.4.2 The economic operator encloses the original copy of the application
      for partcipation with the whole documentation and samples from printed
      editions in a sealed internal envelope where a full name and address of
      the economic operator shall be stated. The sealed internal envelope is
      closed in an external envelope which:
      — is addressed with the correct address of the contracting authority,
      — contains information for the number of the announcement for awarding the
      contract for public procurement and the date of announcement,
      — In the left corner there is a warning, „Do not open“, so that the
      envelope is not opened before the time and date for submission of the
      application for partcipation.
      4.4.3 If the envelopes are not sealed or marked as asked, the contracting
      authority does not take any responsibility for their delayed and
      incomplete arrival in its archive or for early opening of the application
      for partcipation.
      4.5 Deadline and place for submission of the applications for
      participation
      4.5.1 The deadline for submission of the applications for partcipation is
      on the date ... , at ... o'clock.
      4.5.2 The applications for partcipation are submitted in the archive of
      the Ministry of Health on the following address: 50ta Divizija Street no.6
      1000 Skopje, labeled „For restricted procedure no. ... “.
      4.5.3 The application for partcipation submitted after the deadline for
      submission of the applications for participation are rejected as delayed
      and the same will be returned back unopened to the economic operator.
      5. Opening and evaluation of the applications for participation
      5.1 Opening of the applications for participation
      5.1.1 The opening of appplications will not be public
      5.1.2 The subject of evaluation will not be applications for participation
      submitted after the deadline for submission of the applications for
      participation stated in item 4 of the tender documentation.
      5.1.3 If the contracting autority recieves a smaller number of
      applications for participation until the deadline from the minimum number
      of candidates, the contracting autrhority will submit written invitations
      for submission of bids in the second stage of the restricted procedure
      stated in item 1.4 of the tender documentation, he maintains the right to
      dismiss the procedure or to implement the procedure only with those
      candidates who meet the criteria for determening the ability, provided
      their number insufficient to provide a real competition.
      5.2 Confidentiality of the procces of evaluation of the bids
      5.2.1 Not any information about the review and evaluation of the
      applications for partcipation of the procces of their evaluation will be
      disclosed to the candidates or any other person who is not officialy
      involved in the same.
      5.3 Clarification about the applications for partcipation
      5.3.1 In the time period for review and evaluation of the applications for
      participation, the contracting authority may ask from any candidate to
      clarify his application for partcipation. The required clarification from
      the contracting authority is in written form. Changes in the content and
      the documents from the application for participation will not be required,
      offered or allowed.
      5.3.2 Each clarification submitted by the candidate in terms of his
      application for partcipation which is not given as a reply to the request
      from the contracting authority, will not be taken into consideration.
      6. Notification of candidates
      6.1 Notification of the completed pre-qualification
      6.1.1 No later than 3 days from making the decision about the chosen
      candidates who will receive written invitation for submittion of offers,
      the chosen candidate will be notified in a written form for the completed
      pre-qualification and he will receive a written invitation for the
      submission of tender. At the same time, all other candidates will be
      notified for the results from the completed pre-qualification, the
      decision for the chosen candidates who will receive a written invitation
      for submitting an offer, as well as the reasons for rejecting the
      candidate.
      6.1.2. Candidates who participated in the procedure have the right to
      review the report of the conducted procedure.
      7. Legal protection
      7.1 Each economic operator who has a legal interest in the contract for
      public procurement and who has suffered damage or can suffer damage from
      the possible violations of the regulations from the Law on public
      procurement, may ask for a legal protection against the decisions, the
      activities and the failure of taking action by the contracting authority
      in the procedure for awarding the contract for public procurement.
      7.2 The appeal shall be filed within eight days from the day of:
      — publication of the announcement for awarding the contract for public
      procurement in terms of information, activities or failure of taking
      action from the announcement,
      — Missing the dead line for submission of the applications for
      partcipation in terms of activities or failure of taking action connected
      with the tender documentation,
      — the receiving of the decision which determines the individual right of
      the procedure for awarding public procurement, in terms of determining the
      ability of applications for participation or evaluation of bids or,
      — Aknowledgements for illegal conduct of proceedings for awarding the
      contract for public procurement, within one year from the date of the
      completed procedure.
      7.3 The economic operator who failed to file an appeal regarding the
      regulations from subsidiary point 7.2, does not have any right for appeal
      in the later stage of the procedure for the same legal basis.
      7.4 The appeal must contain the following elements:
      — information for the complainant (Name and Last name, name of the
      economic operator, address of residence and headquarters),
      — information for the representative or the attorney,
      — name and residence of the contracting authority,
      — number and date of the procedure for awarding the conract for public
      procurement and information for the announcement for awarding the contract
      for public procurement,
      — number and date of the decision for the choise of the winning bid,
      dismissal of the procedure and other decisions of the contracting
      authority,
      — information for the activities or failure of taking action by the
      contracting authority,
      — descripion of the facts,
      — descripion of irregularities and explanation of the same,
      — proposal of evidence,
      — appeal request and / or request for reimbursement of the cost of the
      procedure and,
      — Signature of autorised person and seal.
      7.5. The complainant shall also submit a proof for payment of compensation
      for conducting the proceedings.
      7.6 The complainant who does not have headquarters on the territory of the
      Republic of Macedonia is obliged to appont an attorney for receiving it in
      written form.
      7.7 The appeal shall be filed with the State Commission. The appeal shall
      be filed personally or by registered mail to both the contracting
      authority and the State Commission. Date of filing of the complaint by
      registered mail is considered the day of submission. In case of personal
      filing of appeal, the contracting authority shall issue a receipt
      confirming the time of admission.
      7.8 In proceedings before the State Commission the complainant, despite
      the administrative fee, also pays a fee for the procedure depending on the
      amount of the bid, including:
      — to 20.000 euro in denar equivalent, a fee of 100 euro in denar
      equivalent,
      — from 20.000 euro to 100.000 euro in denar equivalent, a fee of 200 euro
      in denar equivalent,
      — from 100.000 to 200.000 euro in denar equivalent, a fee of 300 euro in
      denar equivalent or,
      — More than 200.000 euro in denar equivalent, a fee of 400 euro in denar
      equivalent.
      7.9 In the absence of a bid, the fee for the procedure is calculated based
      on the estimated value of the contract, the State Commission shall inform
      the complainant for the fee and the deadline within which to submit proof
      of its payment.
      7.10 The fee for the proceedings is meant for the budget of the Republic
      of Macedonia.
      8. Cancellation of the procedure
      8.1 The contracting authority may cancel the procedure for awarding public
      contracts in the following cases:
      — the number of candidates is less than the minimum number set for the
      procedures for awarding public contracts pursuant to this Law,
      — there isn't any submitted bid or no acceptable or appropriate bid,
      — acceptable bids are submitted that can not be compared due to different
      approaches in technical and financial proposals,
      — there are unforseen changes in he budget of the conracting authority,
      — bidders offered prices and conditions for execution of the contract for
      public procurement which are less favorable than the actual market,
      — evaluation that the tender documentation has major flaws or deficiencies
      to the point of opening the bids,
      — due to unforeseen and objective circumstances the needs of the
      contracting authority are changed or,
      — The contracting authority can not choose the best offer due to
      significant violations of law under Article 210 of this Law.
      9. Completion of the procedure for awarding a public procurement
      9.1 The procedure for awarding public contracts ending on the day of the
      decision for selection or cancellation of the procedure.
      9.2 Immediately after the procedure, the contracting authority shall
      return the samples, templates and documents that he predicted to be
      returned to the bidders in the tender documentation.
