      SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION

      III.1) CONDITIONS RELATING TO THE CONTRACT

      III.1.1) Deposits and guarantees required: See tender documents.

      III.1.2) Main financing conditions and payment arrangements and/or reference to the relevant provisions regulating them: See tender documents.

      III.1.3) Legal form to be taken by the grouping of economic operators to whom the contract is to be awarded: Only one legal entity from a group of companies can apply as a candidate. However, more legal entities from a group of companies can apply jointly as candidate in the form of a combination. ‘Group of companies’ is taken to mean a legal entity with its subsidiary companies in the meaning of article 24a, Book 2, Civil Code of The Netherlands. If the application takes place in contravention of the aforementioned, only the application of the candidate which was submitted first shall be handled.

      III.1.4) Other particular conditions to which the performance of the contract is subject: No.

      III.2) CONDITIONS FOR PARTICIPATION

      III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers: Information and formalities necessary for evaluating if requirements are met: a) The candidate shall enclose a recent certificate of registration in the commercial or professional register of the country of incorporation or a certificate as referred to in article 47 paragraph1 BAO. The certificate shall have to contain his current information. The certificate shall describe the current information and cannot be older than six months, from the closure of submission of the tender;
      b) The candidate shall have an authorised managing director (therefore no holder of a power of attorney) sign a statement in accordance with the model attached, stating that the reasons for exclusion, as referred to in article 45 BAO do not apply to the candidate; c) If the candidate forms part of a holding/group of companies, he shall include an organization chart of the structure of the holding/group of companies, including the name, address and registered office of the group of companies.

      III.2.2) Economic and financial capacity: a) The candidate shall submit financial information in the form of the annual reports of the company over the last two fiscal years, where necessary accompanied by additional information in the form of an "own declaration" (that is – if not clear from the annual report - ) showing:
      i) The average annual turnover of the tenderer, and ii) The average specific annual turnover over the last 2 financial years, generated, based on the execution of services, comparable to the services required under the Framework Agreement for which the candidate is applying.
      b) The candidate shall submit a recent certificate of insurance (e.g. a copy of the policy) against business and professional liability, including a statement of the amounts insured.

      III.2.3) Technical capacity: Information and formalities necessary for evaluating if requirements are met: a) For a Candidate to be eligible for participation in the second phase of the procedure the Candidate shall demonstrate that the organisation of the candidate holds a minimum of 50 employees (in the employ of the candidate) with demonstrable expertise and experience on (and adequately divided over) the relevant disciplines required for execution of the services asked for in this document. The candidate shall provide information as to the number of personnel in its employ that have a background in / are experienced on. (please state the number of employees per discipline, with applicable fields of expertise):
      (i) design and engineering services (plus the number of years of experience per relevant employee) (ii) Construction Supervision (iii) Expert support services in the area of procurement, planning, permitting, legal. (iv) The office location(s) where such personnel is working
      b) The candidate shall submit a statement that the executive management staff is competent in the English language, verbally as well as in writing, and that the written correspondence can take place in the English language. Due to permit requirements, use of the German language in specific documentation and in contacts with the local authorities (such as permit applications, studies, surveys, meetings, communication etc) is mandatory. The Candidate shall submit a statement that the executive staff of the Candidate – where necessary - in view of documents and services required to be submitted/performed in the German language, has the experts available that are competent in the German language; (are native speaker; familiar with the local situation). Candidates – German as well as non-German – shall indicate, at Gasunie’s first request, how they intend to comply with the conditions in this paragraph.

The copy of the writ of summons shall be attached to such notification send to the Contracting Authority. The deposition of a claim with / against the Contracting Authority shall not cause or result in a suspension of the tender procedure (unless and until so ordered by the relevant court). The aforementioned term applicable to objections / a claim on the part of a candidate, shall commence on the day that follows the date of dispatch of the notification in writing to that candidate that he has not been selected. This term ends on the fifteenth day at 5 PM.
