Tenders are invited from interested parties for the design and build of the Smart Innovation Hub (otherwise known as MCIL / KIEIL / Hub 1) under a single-stage design and build contact. The proposal is to create an iconic new building on the Keele University Science and Innovation Park at the gateway in to the Keele University campus.
Early stage and growth potential research and innovation businesses (benefiting from the expertise of co-located) Keele (University) Management School, will accommodate offices on the ground and first floors. A large central atrium area will connect a range of flexible spaces on the lower ground floor, the use of which will be shared between research and innovation businesses, teaching and research.

II.2.4)Description of the procurement:
The Smart Innovation Hub is a new, BREEAM excellent stand-alone building to be located on Plot 2 of the Keele University Science and Innovation Park. The new building will accommodate research and innovation intensive early stage and growth potential businesses and Keele University Management School (Faculty of Humanities and Social Science). Multi-functional spaces will be used by both user groups.
The works will be procured under a single stage design and build contract. The design team (Architect and Civil and Structural Engineer only) will be novated to the successful main contractor on appointment.
The Form of Contract to be utilised will be the NEC3 Engineering and Construction contract as will be amended by KUSBPL as specified in the procurement documents.
Tenderers are invited to submit variant bids. Any Tenderer submitting a variant bid is also required to submit a compliant bid. The minimum requirements to be met by the variants and any specific requirements for the presentation of an offer which contains variants are stated in the procurement documents.
The Smart Innovation Hub is part funded from the European Regional Development Fund (ERDF) as part of the European Structural and Investment Funds England Growth Programme 2014-2020, Staffordshire County Council, the University of Keele and the Department for Business, Energy and Industrial Strategy (BEIS) Single Local Growth Fund.

Completed Selection Questionnaire responses will be assessed against the selection criteria (detailed in the Selection Questionnaire) to arrive at a short-list of Tenderers who will be invited to submit tenders.
It is estimated that five Tenderers will be invited to submit tenders although KUSBPL reserves the right to change this number.
In accordance with regulation 65(7) of the Public Contracts Regulations 2015, KUSBPL also reserves the right to only invite those Tenderers meeting the selection criteria even if this falls below the statutory minimum number of five.

Tenderers remain responsible for all costs and expenses incurred by them or by any third party acting under instructions from the Tenderer in connection with taking part in this procurement, regardless of whether such costs arise as a direct or indirect consequence of any amendments made to the procurement documents by KUSBPL at any time.
KUSBPL reserves the right at any time to: i) reject any or all responses and to cancel or withdraw this procurement at any stage; ii) award a contract without prior notice; iii) change the basis, the procedures and the timescales set out or referred to within the procurement documents; iv) require a Tenderer to clarify any submissions in writing and/or provide additional information (failure to respond adequately may result in disqualification); v) terminate the procurement process; and vi) amend the terms and conditions of the selection and evaluation process.
Tenderers will be subject to a financial assessment to evidence that they have an acceptable level of financial standing to deliver a contract of the Smart Innovation Hub's size and complexity. As part of this assessment, Tenderers will be required to evidence that their average annual turnover over the previous three financial years was at least 25 000 000 GBP (noting that, where a Tenderer is bidding as a consortium, this threshold shall apply in the aggregate to the consortium members as a whole, provided that the lead consortium member's average annual turnover over the last three years meets or exceeds 70 % of the requirement).
In conjunction with the above, KUSBPL will undertake an N2 Check credit report in respect of the Tenderer. Tenderers may be excluded from the process where their N2 Check Risk Score is 40 or below out of 100.

For the avoidance of doubt, the contract duration expressed in Section II.2.7 indicates the anticipated design and build programme of the Smart Innovation Hub only (ie 18 months). There will be defects obligations, followed by typical latent defects obligations on the Contractor (potentially lasting for up to 12 years following such ‘taking over’, in accordance with usual latent defects obligations under building contracts executed as deeds).

Any review proceedings should be promptly brought to the attention of the Directors of KUSBPL at the address provided above, and will be dealt with in accordance with the requirements of the Public Contracts Regulations 2015 (‘PCR 2015’). Any review proceedings must be brought within the timescales specified by the applicable law, including without limitation, PCR 2015. In accordance with PCR 2015, the University will incorporate a minimum 10 calendar day standstill period from the date information on the award of the contract is communicated to tenderers.
