    Aufgabe
    The City of Helsinki is organizing an open international competition for the South Harbour in Helsinki. The competition is a part of the World Design Capital Helsinki 2012 programme.
    The entrants' task is to create a comprehensive ideas plan for the South Harbour that can be used as a basis for the future development of the area. The entrants must present public urban spaces for the area, chart the amount of supplementary construction and placement possibilities as well as improve pedestrian traffic and cycling connections and spaces. The competition area must be linked more tightly to the city centre structure.
    The entrants must examine how the space use of port operations can be made more efficient. The competition entries must consider, in particular, the area's cityscape-related and cultural-historic values as well as appearance to the sea.
    The competition area is the entire shore area of the South Harbour. The size of the competition area is 23,06 hectare.
    The competition is open to everyone. It is desirable for the entrants to form design groups with a varied composition of experts in the fields of land use and architecture, landscape architecture as well as traffic, community, construction and energy technology and harbour operations.
    The competition languages are Finnish and English.

      II.1.2) Short description

      SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION

      III.1) CRITERIA FOR THE SELECTION OF PARTICIPANTS
      With reference to the prevention program of the City of Helsinki against
      the grey economy the competition organiser requires that the entrepreneur
      shall be registered with the business information system, trade register,
      the preliminary tax withholding register, the register for taxable persons
      liable for value added tax and the tax administration’s register of
      employers or equivalent registers in its country of domicile, if the
      registration is required according to the legislation. In addition, the
      organiser requires that the entrepreneur shall have properly paid all
      taxes and statutory pension insurance payments. When participating to the
      competition the competitor affirms that he has taken care of these.
      When the City of Helsinki requires for clarifications before publishing
      the results of the competition and paying the awards and redemptions and
      before the possible assignment on the further planning, the entrepreneur
      shall furnish an extract from the trade register and a clarification
      obtained from the tax authorities regarding the payment of taxes, a
      clarification from an insurance company concerning the payment of
      statutory pension insurance payments as well as a clarification concerning
      collective labour contract applied or other clarification concerning
      essential terms of employment or similar clarifications according to the
      legislation of its country of domicile. An equivalent clarification shall
      also be obtained from subcontractors and presented to the City of
      Helsinki. The clarifications shall not be older than three months. The
      entrant shall provide a list of the persons participating in the
      preparation and delivery of the City’s procurement.
      The City of Helsinki may choose not to pay the award or redemption or not
      to commission planning or has the right to cancel the agreement during the
      period of its validity, if the entrepreneur is not registered in the above
      mentioned registers, if the registration is required according to the
      legislation, or if the entrant is an entrepreneur or a company whose
      partner or member of the board or managing director or equivalent person
      has a ban on business operations. The City of Helsinki may choose not to
      pay the award or redemption or not to commission planning or has the right
      to cancel the agreement during the period of its validity, if the
      entrepreneur has been negligent in the payment of taxes or statutory
      pension insurance payments or if the City considers on the basis of the
      clarification that the entrepreneur is guilty of a serious error in the
      professional activity. The entrepreneur can however be accepted, or the
      agreement can remain in force, if the negligence can be considered minor
      or if a payment plan approved by the authorities is furnished to the City.
      If the certifications are not provided in the entrepreneur’s country of
      domicile, a declaration on oath given to the authorities of the country of
      domicile of the entrepreneur can be accepted as evidence. If the entrant
      considers that he is not liable to furnish the required clarifications, he
      shall furnish the city a clarification about this. The City of Helsinki
      may choose not to pay the award or redemption or not to make an agreement
      or has the right to cancel the agreement during the period of its
      validity, if the entrant is guilty of giving essentially false information
      when furnishing the above mentioned clarifications or if the entrant does
      not furnish the clarifications within the specified time-limit.

      number and value of the prize(s) to be awarded Awards mounting to 165 000
      EUR will be distributed as follows:
      — I award 60 000 EUR,
      — II award 45 000 EUR,
      — III award 30 000 EUR.
      In addition, two redemptions worth 15 000 EUR will be given.
      The jury can, by common consent, divide the award sum in another manner
      for justified reasons. In addition, the jury can give out honorary
      mentions. If the competition organiser so wishes, it can redeem more
      entries than those mentioned above.
      If necessary, a second phase of the competition will be organised between
      2 to 6 entries. In the second phase, the entries will be developed
      according to the further planning instructions provided by the jury.
      In addition to the first phase awards, those invited to participate in the
      second phase are each given an equal share of the total sum of 60 000 EUR.
      Awards and redemptions are given out when the competition has ended.
      However, the jury can skip the second competition phase.
      The City Planning Board will make the procurement decision as required in
      the Section 73 of the Act on Public Contracts based on the competition
      result record of the jury.
      Tax exemption will be applied for the competition awards for 2012.

      VI.2) ADDITIONAL INFORMATION
      Competition procedure:
      The competition is subject to the conditions mentioned in the competition
      programme.
      In case of interpretational or other differences between versions of the
      conditions in different languages, the wording of the Finnish version
      shall be followed.
      When submitting an entry, the competitor accepts the competition programme
      and the competition conditions.
      The competition begins 2.5.2011 and ends 30.9.2011.
      If a member of the jury becomes prevented from participating in the work
      of the jury, a new member will be selected to replace him/her. Any changes
      in the composition of the jury will be notified to the entrants on the
      competition website in English www.southharbour.fi or in Finnish
      www.kirjavasatama.fi.
      Further measures arising from the competition:
      The City of Helsinki may commission further planning from the winner of
      the competition or, in case of several winners, one of the winners. In
      this case, all the winners will be invited to negotiations.
      Public access to documents:
      The procurement decisions related to the competition and their appendices
      are public. The competition entries are public and they will be publicly
      displayed according to the competition programme.
      If, in the opinion of a competitor, a portion of the documentation
      contains trade secrets, notification of this information shall be made in
      a separate appendix. The competition organiser shall decide if the matters
      presented as trade secrets can be considered confidential by law.
      Settlement of disputes:
      The Finnish law in force applies to the competition and the contracts.
      Possible disputes that cannot be settled will be left for the decision of
      Finnish courts, matters in the jurisdiction of a district court in the
      district court of Helsinki.
      Submission of entries:
      The competition ends on 30.9.2011. The competition entry must be either.
      1) delivered by 4 pm on 30.9.2011 to the City of Helsinki Registry at the
      address shown below; or
      2) given on 30.9.2011 to be transported by the post or another transport
      instance as home delivery. In such case, it is the entrants'
      responsibility that the entry arrives no later than 14.10.2011. The
      dispatch must have a date of dispatch marked by the post or another
      transport instance, which must not be later than 30.9.2011.
      In both cases the top side of the dispatch must be marked with the
      pseudonym as well as "South Harbour - ideas competition".

      A seminar pertaining to the competition and open to all will be arranged
      on 27.5.2011 at 10 am in Wanha Satama, at the address Kanavakatu 5,
      Helsinki. Registrations for the seminar are expected by 16.5.2011 via the
      competition website.

      information on the programme. All questions must be made anonymously and
      sent via the form that is available on the competition website no later
      than 31.5.2011. The questions and jury's answers will be published by
      4.7.2011 on the competition website.
